90-day money-back guarantee
On top of the statutory right of withdrawal you have 90 days from delivery to return the Kitchenforest.
In that time you may fill it, plant it, let it grow and harvest it. If you return it afterwards, we refund the full purchase price. We charge no compensation for the use.
Register the return informally at hey@upgreens.team with your order number. You do not need to give a reason. You pay for the return shipping.
The 90 days only apply with the original packaging. If the Kitchenforest comes back without it, we cannot accept the return. So keep the box for the 90 days.
What goes back: device, light bar, rods, pots, power supply and cable. Used substrate, seeds and plant nutrient stay with you and nothing is deducted for them. Empty the pots and the water tank before shipping.
If the device comes back damaged, if parts are missing or if the electrics, the watering or the structure have been tampered with, we deduct the estimated loss in value from the refund. A defect covered by our guarantee does not count towards that; we handle that one for you.
If you send the Kitchenforest back within the first 14 days, unused and in its original packaging, we refund the return shipping up to the cost of standard shipping on top.
The guarantee applies to the standard colors Pfeffer, Salz, Sesam and Safran, ordered in the Upgreens shop, delivered to Germany or Austria, once per customer account and delivery address. It does not apply to individually configured versions, because those are built for you alone. The full conditions are in § 8 of the terms.
Exceptions from the right of withdrawal
There is no right of withdrawal for contracts on the supply of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer.
This covers individually configured versions as well as versions in a color made to customer specification or from a material sent in by the customer. These are manufactured only after the order arrives and exclusively for that customer.
For the articles concerned, the absence of the right of withdrawal is pointed out separately before the order is placed and confirmed by the customer.
There is furthermore no right of withdrawal for contracts on the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery. This concerns the sealed consumables of the starter kit, namely seeds, substrate and plant nutrient.
For the standard versions in the colors Pfeffer, Salz, Sesam and Safran the right of withdrawal applies without restriction, even when they were put together through the configurator.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
If you ordered several goods in one single order that are delivered separately, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item.
If goods are delivered in several part-shipments or pieces, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last part-shipment or the last piece.

by means of a clear statement (for example a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, which is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
End of the withdrawal policy
Which route applies to you
With the statutory withdrawal within 14 days you may unpack the Kitchenforest, set it up, connect it to the power, switch on the light and fill the water tank. That examination matches what would be possible in a shop and leaves your claim to a full refund untouched. Once you fill in substrate and sow, the frame of an examination is exceeded; for that we charge compensation for the loss in value under § 357a (1) of the German Civil Code.
That is exactly what the 90-day money-back guarantee is for. There you may plant, let it grow and harvest, and you still get the purchase price back in full. No compensation applies, and opened substrate, seeds and plant nutrient do not stand in the way of a return.
You pay for the return shipping in both cases. If the parcel goes out within the first 14 days and the Kitchenforest comes back unused and in its original packaging, we refund it.
