Exceptions to the right of withdrawal
There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer.
This includes all versions ordered via the configurator, versions in a color produced to customer specification, versions with an individual print or individual engraving, and front adaptations based on a decor specified by the customer. These versions are only produced after receipt of the order and exclusively for the respective customer.
The absence of a right of withdrawal is pointed out separately for the affected items before the order is placed and is confirmed by the customer.
Furthermore, there is no right of withdrawal for contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This concerns the sealed consumables of the starter kit, namely seeds, substrate and fertilizer.
For the versions of the collection in the colors Pfeffer, Salz and Sesam, the right of withdrawal applies without restriction.

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.
If you have ordered multiple goods in one order and they are delivered separately, the withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.
If goods are delivered in several lots or pieces, the withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last lot or piece.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, a fax or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
We will bear the cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
End of the withdrawal policy
Inspecting and withdrawing in practice
To check the nature, characteristics and functioning, you may unpack the Kitchenforest, set it up, connect it to the power supply, switch on the light and fill the water tank. This inspection corresponds to what you could do in a physical store and does not affect your right to a full refund.
Once the device has been filled with substrate and planted, the scope of an inspection has been exceeded. The device can then no longer be returned to sale. For the resulting loss in value, we charge compensation pursuant to § 357a (1) BGB, which can amount to as much as the purchase price and is offset against the refund.
The sealed consumables of the starter kit remain unopened until the decision on withdrawal has been made. Once the seal has been opened, withdrawal is excluded for this material.
